KOTA KINABALU, The Sabah State Legislative Assembly today approved a motion to amend the Syariah Courts Enactment 2004 to strengthen and streamline the management of inheritance in the state.
Sabah Science, Technology and Innovation Minister Datuk Mohd Arifin Mohd Arif when tabling the motion said the amendments involved three clauses with Clause 1 containing the short title and the date of coming into operation of the proposed enactment.
Clause 2 seeks to provide a clear provision on the jurisdiction of the Syariah Court to hear and decide on any matter relating to the succession of estate.
Clause 3 seeks to increase the civil jurisdiction for the Syariah Subordinate Court from RM100,000 to RM300,000.
“The Syariah Court is also in an effort to formulate rules and recommendations so that the inheritance of Muslims is managed in a more orderly manner. Therefore this matter (amendments to the enactment) will strengthen the draft proposal that will be submitted," he said.
The assembly also approved the amendments to the Fatwa Enactment 2004, Fees Enactment 1981 and Rural Administration Ordinance.
Mohd Arifin, when tabling the bill, said the amendments to the Fatwa Enactment 2004 were to improve the procedure in making a fatwa and to provide for the vacation of office of the Mufti and Deputy Mufti.
The assembly then adjourned sine die.
